Video: Texas gym closes; no warning to members…Owner in hot water for a fraudulent prescription for hydrocodone
TYLER, TEXAS (KLTV) –
A former Tyler business owner and manager awaiting punishment for felony charges has received notice of her business foreclosure and eviction.
Apple Swim and Fitness off of Timber Creek Drive in Tyler offered a fitness club, as well as tennis courts and a swimming program.
There are two different notices placed on their property and their locked gates are obviously keeping customers out.
The first notice, dated July 31st by The Code Enforcement Department, demanded that the high weeds be cut by the tennis courts, and if not, the City of Tyler would correct it at the owner’s expense.
On August 3rd a formal notice and demand was placed on their door, demanding that all of their agents, employees, and representatives vacate the property within three days of the notice, and if not, Zions First National Bank will institute a forcible eviction.
Several customers have driven by the gym, unaware of the fitness gym and pool closing.
“I’m shocked, because we would like to swim, and you know it was great, my kids are disappointed. We’re here, ready to swim and no phone call,” said Tyler member Stacey Chiasson.
After talking to a few employees on site, they have no comment about re-opening. But the notice says by foreclosure, Zions First National Bank became owner of the property on July 3rd.
The owner of Apple Swim and Fitness, Tara McSwain, is scheduled to be sentenced September 4th for two counts of fraudulent possession of a controlled substance.
In June 2011, McSwain tried to pick up a fraudulent prescription for hydrocodone
