Planet Fitness responds to NY AG’s crackdown on indoor tanning.

Planet Fitness says it is working with its franchisees to comply with New York tanning laws after the state’s attorney general began an investigation two years ago.

Attorney General Eric Schneiderman today sued Total Tan and Portofino, claiming they aren’t following state tanning laws.

Schneiderman also sent letters of intent to sue to Planet Fitness and a second tanning business. You can read the letter below.

Here is the response today from Planet Fitness:

“We are aware of the notice from the New York Office of the Attorney General arising from an investigation into tanning services at certain Planet Fitness franchise locations in New York. In April and May 2013, the Office of the Attorney General found that five of the approximately 80 Planet Fitness franchise locations in New York at the time were allegedly in violation of certain laws related to tanning services.

“Since being notified of these alleged violations, Planet Fitness Corporate Headquarters has worked closely with all franchisees to emphasize the importance of following all applicable state laws. Additionally, over the last year, Planet Fitness has been working with the Office of the Attorney General with regard to this matter, and we look forward to the opportunity to continue to work with their office in mutual good faith to reach a resolution.”
