Gym owner goes to federal appeals court

 

Michael Jordan has appealed its Chapter 11 bankruptcy case to the Seventh Circuit Court of Appeals has appealed its Chapter 11 bankruptcy case to the Seventh Circuit Court of Appeals, part of a last-ditch effort to retain ownership of the 56,000-square-foot building. The appeal filed by Timothy Grover’s Attack Properties LLC comes less than two weeks after a U.S. District Court judge affirmed an earlier decision to dismiss the case. The venture also filed a motion to block a foreclosure sale originally scheduled for Sept. 19, court records show, though that request was denied by the District Court judge. The foreclosure sale is now scheduled to take place Wednesday, according to William J. Barrett, a lawyer for the venture that holds the senior loan on the property at 2641 W. Harrison St. Mr. Barrett said he was not surprised by the appeal and expects “the same outcome.” Mr. Grover and his lawyer did not immediately return messages Monday requesting comment.
