Anytime Fitness looks to skirt regulation with new bylaw

 The attorney for Anytime Fitness wants to give voters a chance to pass a bylaw that would supercede the town regulation that is the subject of a lawsuit against the town.

Board of Health member Dan Sapir objected to discussion of a bylaw change proposed by attorney Rob Kraus with the town in litigation with Anytime Fitness. He said he’s disappointed in Kraus.

“I suggest Mr. Kraus allow this to work its way out in the courts,” he said.

Kraus said his purpose Tuesday night was to make the public aware of the potential of a bylaw proposal at Town Meeting.

A Superior Court judge ruled in June that Anytime Fitness must operate in line with the town’s bylaw regulating health clubs. Anytime Fitness owner Jake Pylant appealed that decision.

The town requires that a staff member trained in the use of an automatic external defibrillator be on duty at health clubs during business hours. Kraus has argued that the town oversteps its bounds by approving a bylaw that’s more stringent than state regulations.

Kraus said the proposed bylaw would be in line with state regulations.
