State suit filed against International Sports Club.The Indiana Attorney General’s office is suing Tippecanoe County gym International Sports Club for violating the Deceptive Consumer Sales Act. In the suit filed earlier this month in Tippecanoe Superior Court, it names 12 plaintiffs who claim the club, under ownership of Paul Fortwendel, continued to charge them membership fees after they canceled their contracts. According to court documents, International Sports Club provided one and two year contracts. To cancel a contract members must pay a $75 fee, turn in their membership cards, provide evidence they are moving outside of a 30 mile radius of the gym and have all payments up to date. The plaintiffs say they did that, but continued to get charged. At times, the plaintiffs stopped payments only to have Forwendel’s billing company place adverse information of the consumers’ credit reports. For relief, the state is asking for $5,000 in civil penalties per violation knowingly committed. As well as $500 per violation committed intentionally.
