A city of Garden Grove resident alleges she is being unlawfully contacted by a debt collector.
Katie E. Scott filed a complaint on Jan. 10 in the U.S. District Court for the Central District of California against Gold’s Gym International Inc., Gold’s Gym Southern California Group and Swift Funds LLC citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that beginning in January 2015, she suffered damages from receiving several collection calls from Swift Funds on behalf of Gold’s Gym. The plaintiff holds Gold’s Gym International Inc., Gold’s Gym Southern California Group and Swift Funds LLC responsible because the defendants allegedly kept on calling the plaintiff despite filing for bankruptcy and despite her requests to stop calling her.
The plaintiff requests a trial by jury and seeks $500 as statutory damages, statutory damages of $1,500, injunctive relief, and any other relief as the court deems just. She is represented by Sara F. Khosroabadi and Joshua Swigart of Hyde & Swigart in San Diego.
